You need to file a rent overcharge complaint with the DHCR. The DHCR will determine your stabilized status, legal rent and any overcharge amount.

You can serve a notice to cure. If he does not comply you can terminate the tenancy and then start a holdover eviction proceeding.

Unless you have been ordered to pay rent by the court, its best to hold the rent and let the judge tell you who to pay it to.
