Not sure what you mean by come to the U.S. illegal and that would influence the answer. YOu should speak to a lawyer as your case is not straight...

Applying while here on a Visa is not the problem but if you came to the U.S. in 2007, you have already missed the one year bar to apply for asylum....

This is correct..one thing to add..when you change back to H1-B, you will not be subject to the quota.
