Abunaim v. Newark Beth Israel Hospital
Mar 07, 2003OUTCOME: Dimissed by Motion
Plaintiff was a small child who died while being treated at another Hospital. The deceased child was rushed to Newark Beth Israel Hospital whose pediatric doctor tried in vain to resuscitate the child. ... Plaintiff sued for medical malpractice and wrongful death. New Jersey requires an affidavit of merit as to medical malpractice from a doctor with the same expertise as the defendant doctor. Mr. Sarno proved to the court that the plaintiff expert was not a licensed professional having lost his license for prescription abuse. The court accepted Mr. Sarno's argument that the plaintiff attorney had an obligation to confirm the status of the expert witness.
