The USCIS relies on the most recent tax returns so you should be fine. However, she may need to explain the lack of filing taxes in 2012 and 2013.

Your husband may apply for a B-2 Visa at the U.S. consulate, but there is no guarantee that he will be granted. Since he is married to a U.S....
