Positive Experience With a Total Professional

I retained Mr. Levenson for a complicated and sensitive matter. Ultimately, his representation was successful. Over a period of almost 3 years he made himself available after office hours and on weekends and responded to phone calls and emails promptly as did his staff. I Was Asked to Commit Perjury

The assistant district attorney offered me a plea bargain that would have meant I would have had to commit perjury although I told Mr. Levenson that he tried to pressure me into taking the deal and told me exactly what to say. I REFUSED to take the deal because I refuse to lie in court. Despite havin...g been my defense attorney, he was more interested in the complainant's best interest rather than mine. Mr. Levenson screamed in my ear, made several profane comments to me, did not listen to points that I made, he made comments to me that made me EXTREMELY uncomfortable, and never apologized for anything including the fact that he refused to speak to the assistant district attorney for a week until my husband sent him a several page fax explaining that if I took the deal I would be committing perjury. When I asked him why he thought I should take the deal he eventually told me that he thought I was, "exaggerating". Nothing in what I had written regarding the complainant could have been exaggerated. He treated me with so little respect from the get go. The disrespect towards me continued to mount and I think that's why he would primarily deal with my husband. Mr. Levenson was disrespectful to me long before I was to him.

In March, 2011, The reviewer of my profile, in was arrested in NYC and charged with Aggravated Harassment. The criminal complaint alleged that Ms. Monte made over 1,000 voicemail calls, several hundred text messages and e-mails using 5 different telephones over a 4 year period from July 2007 to March, 2011. The calls were made to her boyfriend, a respected and prominent NY attorney. Those messages were recorded and she is clearly recognizable. The substance of her rants against him were set forth in the criminal complaint as follows: “you are a terrible person, you are a cold person. You have no feelings. You are a pedophile…you are a corrupt attorney and I will report you to the First Department…I will kill you! I will kill you, your mother, I will kill your brother.” She posted a message on an internet website, “Don’t Date Him Girls.com” where she disclosed in detail all of the intimacies of their sexual life. Significantly, Mrs. Monte was an alcoholic for an undisclosed period of time but included the period 2007-2008. I was retained by her and her husband and appeared on 3/14/11 on her behalf, where the ADA indicated there would be no plea bargain. He also indicated that he had tapes of her calls and copies of her e-mails. When I asked her about this evidence she said she had no recollection of sending any e-mails or making any calls. She stated that she may have been under the influence of alcohol at the time they were sent and may have “blacked out”. She stated that, at times, she would drink two bottles of wine at one sitting. When I pointed out that these messages were sent over a four year period and that it was unlikely that she could have been “blacked out” every time a message was sent, she demurred. I was finally able to convince the ADA to reduce the charges to a non-criminal violation with no probation and no jail time on condition that she discontinue her behavior, withdraw her scurrilous remarks from the internet and admit guilt to simple harassment. She refused. Over a period of several weeks, her husband and I implored her to reconsider, pointing out that if she refused the offer, she would be required to go to trial, that I was virtually certain she would be convicted, very likely be sent to jail, have a criminal record and would have to spend thousands of dollars in attorney’s fees. By pleading to the reduced charge, she would not have a criminal record and would not face jail time. During the course of our discussions, extreme frustration got the better of me and at times I raised my voice. Ultimately, she very reluctantly agreed. Shortly after she took her plea she posted the above remarks on my profile. The absurdity of the remarks are apparent. She accuses me of suborning perjury (herself) when it is clear that she committed the crimes charged. She accuses me of being deficient in the knowledge of the law when the NY Criminal Bar Association honored me with an award in 2010 for “Excellence in the Practice of Criminal Law” and I was hired by St. John’s University to teach Advanced Trial Advocacy for 5 years. She accused me of a lack of experience when I have been practicing for 57 years and was named, “Super Lawyer” by a Thompson Reuters evaluation in both 2012, 2013. She is obviously a very troubled woman and I would normally not respond to insults by such a disturbed and troubled personality. However, where my professional reputation is under attack, I have no choice but to defend myself.
