You need to speak with an attorney ASAP.
There is a radius clause for residence of 40 miles. If I move 35 miles, is the new radius based on my new address or original?

The residence from when you signed it. You don't get a new radius every time you move, otherwise it would make the clause meaningless.

If you relocate out of state with the children without a court order you run the risk of being dragged back into NYS and possibly losing your kids....

Its not clear what type of hearing that you are talking about. The Judge has discretion on what to do, and a default may occur.
