Tell the Canadian to seek H1B. It is a dual intent visa and having it could help avoiding the complications.
In states tuition fee for pending asylum, yet we had interview, just waiting for the results.

Yes, if she petitions and you maintain your nonimmigrnat status for the next 14 years, you will eventually be able to adjust status.

I have H1b Visa valid till Sep 2015 and I797 valid till June 2015. Travelling to India Apr 27 to Jun7th. Do I need my extension?

Your visa governs you reentry. When you do, you will get a new I94 to the end of the petition period, Beyond that, you will need an extension, yes.

My prior employer has not given me my I797 (H-1B approval copy) having my current and original I-94 document.

The law does not require them to share documentation with you with the exception of the I94 portion of the I797

First, inadmissibility waiver is a complicated matter. Handling it pro se is not wise. Secondly, it take time. Lots of time.
