The way the law is now, yes to get his green card, he would have to leave and file a waiver. Hopefully the process will be changed soon...
My i-360 petition did not establish a prima facie ,they request for evidence - that i am a person of good moral character .

you may get a request for evidence. when you get your receipt notice, you can try submitting the "forgotten" disposition with an explanation

I would schedule a consultation with an experienced attorney. Since he came to the US without a visa, he will need a waiver. Hopefully soon there...

cannot work in the US as a visitor. German nationals can come in on a visa waiver. Philippine nationals need a tourist visa to enter for a visit.
