There is no such rule that I have every heard of. It sounds like the Magistrate is taking advantage of the fact that you are pro se.

There is some language that the court can choose not to follow the statutory guidelines in the interest of justice, however, that is rarely granted.

You can file in New York. If there was no order in PA, even though custody was decided there, then you can file in NY and it would be under NY law...
