You need to send them an attorney nasty letter, letting them know that if they do not dismiss, you will sue them for filing a frivilous lawsuit.

You need to plead not guilty and get an attorney to represent you.

I would agree that you cannot be convicted twice for the same offense. But you will have to argue that in court.
