I agree with the previous attorney. Having said that, you wouldn't be the one filing an I-601 in the first place. Your spouse would be doing that.

You should probably review this question with a lawyer in person. You don't want to make an error on the I-130 which could delay your spouse's case.

Unless she qualifies for the English waiver--which it doesn't appear that she would--she must take the English portion.
