NY may have changed to .08 in 2004 when NJ and PA did. If .10 in effect when you were arrested then it will govern your case unless NY...

Technically, since the trial did not begin, there is no jeopardy. Therefore, case can be reopened until the statute of limitations runs(one year)....

Sounds like a weak burglary case, especially if you were intoxicated. Theft case is dependent upon her credibility. You need an attorney.
