May 24, 2013OUTCOME: Threat to Kill - Dismissed; Obstruction of Justice - Dismissed; Disorderly Conduct - Guilty Plea; Resisting Arrest - Guilty Plea. Sentence - Two years Probation.
Client black out drunk - slaps girlfriend. Police called and take client home and give Client a ticket for disorderly conduct, a disorderly persons offense. Client starts drunk dialing girlfriend, le ... aving threatening messages. Client does not recall this. Client goes to girlfriend's house in morning to pick up belongings - commits criminal mischief by breaking window. Domestic Violence Complaint and criminal complaint of "threat to kill." Final Restraing Order entered. Two & 1/2 weeks later, Client allegedly violates FRO by telephoning girlfriend and leaving messages. Police arrive at Client's house to arrest Client that night for violation of the FRO. Client non-compliant and technically resists arrest by not answering door at first and not allowing self to be handcuffed. Client wrestled to floor and arrested. New charges of Resisting Arrest and Obstruction of Justice. Motion to consolidate disorderly charge in municipal court with Superior Court criminal charges. Prosecutor consents to consolidation.
