OUTCOME: Unanimous Decison- Claims against the Egg Harbor Township MUA were dismissed

Howard N. Sobel, Esq.on behalf of the Egg Harbor Township MUA argued that the claimant failed to comply with the requirements of the New Jersey Tort Claims Statute by not providing a timely Notice of C ... laim to the Egg Harbor Township MUA. In addition, he successfully argued that the Discovery Rule, did not apply, as was determined by the trial court. Thus, the decision of the Appellate Court reversing the trial judge was affirmed and the Egg Harbor Township MUA was dismissed from the case, without liability to the plaintiff.
