What is the difference if I hire attorney who is former prosecutor or just a defense attorney for a criminal defense ?

Personally, I think a former prosecutor knows the side he is challenging, very well.

N-400: Apply for I-485 family Based while I-485 Derivative Employment Based is in Pending status.

You can have the case transferred to the I-130, family petition, and revise the I-485. If all goes well you will not need to pay another fee.
