NJ is a "no fault" state so the infidelity will probably be irrelevant as far as alimony. It seems you are entitled to alimony die to the duration...

Your spouse can petition for you but you can't adjust until he becomes a USC. It will be better than nothing, if you fall out of status.

A license is not a requirement. Although it could go to his credibility regarding the judge, the proof will have the greatest weight. So it depends.
