This case involves issues of custody, removal, and support surrounding an unusual agreement entered into between three friends to conceive and jointly raise a child in a tri-parenting arrangement. O.S. ... H. is a female minor child born in 2009. Plaintiff, D.G., is the biological father of O.S.H., and K.S. is the child's biological mother. Plaintiff, S.H., is D.G.'s same-sex spouse, who has bonded with and has become a psychological parent of O.S.H. Following a lengthy plenary hearing, and for the reasons that follow, the court awards joint legal and joint residential custody of O.S.H to all three parties and denies the application of K.S. to remove and relocate the child to a different state.

OUTCOME: The Appellate Division reversed the final divorce judgment as to all issues except that it affirmed the declaration of divorce, itself. The matter was remanded to the Family Part for further proceedings in accordance with the opinion.

Defendant appeals a final judgment of divorce entered after the Family Part struck his defenses and ordered a default against him. After three days of trial, the judge adjourned the proceedings because ... defendant at that time presented plaintiff'scounsel with voluminous documents he wished to introduce into evidence, but had failed to provide in discovery. The Family Part judge ordered defendant to pay $50,000 in attorney fees to plaintiff's counsel to enable counsel to review the documents and thereafter adjourned trial for forty-six days. On the adjourned trial date, the Family Part judge entered default against defendant because he had failed to pay to plaintiff's counsel the fees earlier ordered. Defendant was permitted thereafter limited participation in the continued hearing.

Plaintiff in divorce proceedings instituted on February 3, 2005 against defendant Defendant, appeals from a sentence of fifteen days' incarceration, imposed following an adjudication of contempt, to be ... served in the Middlesex County Labor Assistance Program. On appeal, Lijoi argues that the imposition of a custodial sentence constituted an abuse of the court's discretion. We agree and vacate the sentence.
