On November 17, 2013, Plaintiff was operating his motor vehicle on Belleville Avenue, Belleville, NJ at which time he was struck by a vehicle being operated by Luis Guarida who failed to make proper ob ... servations of plaintiff's vehicle while pulling out of Hornblower Avenue in Belleville, NJ. Plaintiff had sustained an L5-S1 grade 1 retrolisthesis; broad based posterior disc bulge; L4-L5 midline right paracentral extruded disc herniation with underlying disc bulge complicated by moderate spinal stenosis and compression of the descending right L5 nerve root and an annular tear; severe right lateral recess and neural foraminal narrowing compressing the descending right L5 and encroaching on the exiting right L4 nerve roots; moderate left lateral recess and neural foraminal narrowing; and an L3-L4 disc bulge. Dr. Robert Marini performed numerous bilateral L4-L5, L5-S1 facet injections under fluoroscopy and performed radiofrequency ablation of the right L4-L5 and S1 lumbar facet joints and Rhizotomy of the medial branch of the dorsal L4, L5 and S1 lumbar facet arthropathy. The case was tried with Dr. Robert Marini providing expert pain management testimony. An offer of judgement for $50,000 had been submitted prior to trial. Case settled during jury deliberations for $45,000.

As a result of this accident Plaintiff suffered a C4-C5 disc herniation and neck pain that radiates into his shoulder blades; an L5-S1 disc bulge indenting the anterior epidural space with accompanying lower back pain that radiates into his buttocks and down his left leg; displacement of lumbar intervertebral disc. Plaintiff had undergone three sets of epidural injections. Expert testimony was provided by Dr. Didier Demesmin of University Pain Medicine Center-South Plainfield, 1810 Park Avenue, South Plainfield, NJ. His de bene esse videotaped deposition was conducted prior to trial on January 22, 2018. An offer of judgment had been filed on January 5, 2016 for $35,000. Plaintiff was awarded $8,000.
