Decedent was infected with HIV and entered an Illinois class action suit for damages but died before settlement. Plaintiff’s sister, executrix and sole beneficiary under decedent’s will filed suit ... in New Jersey claiming that the estate was entitled to the entire settlement amount. I represented three other siblings who claimed that they were entitled to a portion of the settlement pursuant to New Jersey’s Survivor Act. I argued that comity required the claim to be resolved in the Illinois court where the class action creating the settlement occurred and that the other siblings were entitled to a portion of the settlement as survivors. We prevailed in the New Jersey Appellate Division, which reversed the lower court based on the Survivor Act and the doctrine of comity.
