Matter involved plaintiff alleging that our client served co-defendants while visibly intoxicated. Fight occurred between the co-defendants and the plaintiff resulting in fractured orbits, a ruptured ... spleen, fractured ribs and collapsed lungs. Jury returned an award of $1.26 million but found our client did not serve the co-defendants while visibly intoxicated and was not responsible for the fight. The jury entered a no cause of action as to our client.
OUTCOME: Settlement, no contribution made by client.
This matter involved the failure of an ERISA plan sponsored by the NJLBA. The Secretary of Labor filed suit against the NJLBA and other defendants, including our client claiming that the employee heal ... th plan was mismanaged. At the time of the plan's failure there were approximately $6 million in unpaid claims. The matter was ultimately settled by the various defendants without our client being required to contribute towards the settlement.
OUTCOME: No Cause of Action as to our client.
