About Nicole
Biography
Nicole G. McDonough represents clients in complex commercial litigation matters before the state and federal courts in New Jersey and New York. Her practice includes real estate and construction defect litigation, trademark litigation, employment disputes, probate litigation and contract matters involving small businesses and their owners. Nicole listens to her clients’ needs and works as their problem-solver to formulate a strategic approach to achieving their business and financial goals. She has also represented parties in matters before the American Arbitration Association and the Financial Industry Regulatory Authority and has successfully mediated cases for her clients to achieve settlement early in the process.
An Associate in the firm's Litigation Department since 2008, Nicole counsels clients across the country and internationally in myriad industries, including the real estate/condominium development, information technology, financial services, medical, beverage, designer furniture, resort and automobile industries. Some of her representative matters include:
- Defeating a commercial landlord's attempt to terminate a favorable lease caused by our client's de minimis delay in exercising its renewal option contained in the lease;
- Prevailing on summary judgment to defeat a competitor’s tortious interference and conspiracy claims, which were brought following our client’s desired relocation of its business;
- Successfully prosecuting a trademark infringement claim on behalf of a designer furniture manufacturer, asserting violations of the Lanham Act and Anticybersquatting Consumer Protection Act; and
- Favorably settling a multimillion-dollar claim against a jewelry manufacturer alleging fraud and conversion in its wholesale jewelry pricing to its distributor.
New Jersey Super Lawyers recognized Nicole as a “Rising Star” for 2014, 2015, and 2016.
Nicole’s practice is enhanced by her involvement as a lead barrister in the John C. Lifland American Inn of Court. She is also active in a host of organizations,including the Bergen County Bar Association, New Jersey State Bar Association and New Jersey Women Lawyers Association.
Nicole earned her J.D. from Seton Hall University School of Law, where she was honored as a Dean Scholar. While in law school, Nicole served as a judicial intern to the Honorable William J. Martini, U.S. District Judge for the District of New Jersey. Nicole was also a member of Seton Hall’s Interscholastic Moot Court Board, where she received advocacy and writing honors in multiple national competitions. She enjoys giving back to students interested in the practice of law by serving as the Bergen County coordinator for the Vincent J. Apruzzese High School Mock Trial Competition.
