In general, attorneys' fees and/or sanctions are RARELY awarded in my experience in NJ and NY.
Will my insurance company cover my accident if payment was made day of accident. The policy was Canceled 8 days prior?

Report the accident ASAP and try. If the accident happened before the call/payment was made, you may be out of luck.

Its hard to tell without more info. Your own insurance may cover the rest of it if it is an underinsured situation.
