Plaintiff alleged that he sustained permanent injuries to his neck and back due to a rear-end collission. He had doctor reports confirming same. At trial, plaintiff testified that due to this accid ... ent he now has limitations. The most significant limitation was being able to care and play with his daughter whom is wheel-chaired bound. Testified to how he could no longer pick her up and dance with her since she liked doing that with him. He also admitted that he did have an injury/pain to his neck/back and an MRI of his back before this accident but forgot about it. During my cross-examination I impeached the plaintiff on the following; plaintiff testified that he did have prior neck/back pain and an MRI of his back before this accident, but testified at his deposition that before this accident he never injured/had pain to his neck/back and never had an MRI of his back before this accident. He testified that at the scene of the accident he told the police he had pain, but at his deposition he testified that at the scene of the accident he told the police he was fine. I also cross-examined plaintiff on the damage to his car (which was minimal) and asked him to circle all the damage to his car and produced said pictures to the jury.
