OUTCOME: 10 Yr Sentence Reduced to Time Served and Rehab

Client was on Probation for Aggravated Assault. Client has a significant drug addiction that resulted in new drug-trafficking related charges that also violated his probation. Combined the VOP and new ... charges exposed client to at least 10 years in State Prison. Defense successfully negotiated a sentence reduction to 364 days (with time served as a result of the jail credits client had accumulated to that point) and an in-patient drug rerhab program to assist client in breaking his addiction.

OUTCOME: Mandatory 10 Yr Extended Term Reduced to 18 Months

Client was charged in two indictments with crimes requiring mandatory periods of parole ineligibility of three years for each case. Because client had 5 prior indictable convictions he was therefore fa ... cing a minimum of 10 years with 5 years of Parole ineligibility on each case, which were to run consecutively. Defense successfully convinced the State to sentence client to a single 4 year term with only 18 months of parole ineligibility, and to grant the client 320 days of jail credit against that single sentence.

The police charged client with a 2nd degree gun charge that would have required the imposition of a lengthy State Prison sentenc ... e. Based on defense arguments, the Prosecutor agreed to place the client into the PTI program, for a six month period. No plea was required so client can get this expunged in six months. No conviction. No incarceration and soon, no record.

OUTCOME: Criminal Charges Disposed of as Minor MV

During MV stop, client gave the officer false information regarding her ID, and falsely implicating another real person, by the client claiming to be that other person. Client was in process of being c ... harged with five indictable charges including Identity Theft, Obstructing Justice and others. Based upon the defense arguments during the first court appearance, the State offered client a plea to a minor MV violation that resulted in fines and costs only (less then $200). All criminal charges were waived.

Client had extensive previous criminal conviction history, and was then charged in 5 seperate cases with a consecutive sentencing exposure of at least 25 years, with 12 1/2 years of parole ineligibilit ... y. Plea negotiations resulted in a plea to one case, with a 4 year sentence recommendation from the State. 3 other cases were dismissed, and one other case which had already been pled to was sentenced concurrent to the 4 year term. With the combined jail credits of the cases pled to, client needed to serve only about 6 additional months.

Client was charged with multiple drug trafficking offenses, which combined with his prior record and the fact that he was on Probation already had him exposed to an extended State Prison Sentence of 10 ... years with 5 years of parole ineligibility. After the defense investigated the visibility/ability of the officer to view the activities as described by the police, the defense was able to convince the State that the case had too many legal defencts and convinced the State to agree to a concurrent probation (No incarceration).

Victim suffered permanant serious bodily injury (Brain Injury; Broken Jaw, loss of all teeth - including one knocked into his lung, etc). Case was mis-indicted by Prosecutor (Should have indicted for A ... ttempted Murder). After extensive motion practice and numerous court appearances, I convinced the State to offer the client a minimum term of 3 years - instead of the 10 with 5 years of parole ineligibility we had started with.
