Client was charged with 6 criminal charges. He had a excellent job with the federal government and could not afford to plead out or be found guilty of anything. We had to take a very aggressive appro ... ach and the case was highly contested. At the trial date, we made two pre-trial motions to have the have the case dismissed. Both were granted, leading to the dismissal of all charges. While defense attorneys represent both the innocent and guilty, in this particular case, I was convinced without a doubt that the client had done nothing wrong. This was therefore a very nice win for us and especially the client.
OUTCOME: Firearm Appeal Won in Superior Court
Client applied for a FPIC and PPH at local police department in Passaic County and was denied (as most are). There were various reasons for the denial, most of which occurred decades ago. We appealed ... to the Superior Court. It was a somewhat complicated case - we filed a brief, argued it at our appeal hearing, and were brought back for a second day of argument. The interesting thing is that at the time of the client's application to the police department, he was legally barred from receiving a firearm purchaser card. However, before the appeal hearing, we were able to get those issues resolved. We then successfully argued that the issues in his past background were too remote to disqualify him and that the court should rule on his application "de novo" rather than as it was submitted to the police department. The court agreed, and client got his permits.
OUTCOME: Convinced prosecutor's office to downgrade case to municipal court. Then had case further reduced to non-criminal municipal ordinance.
Client arrested in Howell for felony theft of over $1,000 of hardware. Case sent to Superior Court.
OUTCOME: Case dismissed.
