Focusing his practice primarily on environmental and governmental entity representation, Michael D. Witt works extensively in the area of wastewater regulation and litigation. He has considerable experience handling matters arising under the Federal Clean Water Act, the New Jersey Water Pollution Control Act, the New Jersey Sewerage Authorities Law and the New Jersey Municipal and County Utilities Authorities Law. Since 2000, he has represented the Passaic Valley Sewerage Commission — the fifth largest publicly owned treatment works in the nation — both in court and before the New Jersey Department of Environmental Protection. His outstanding work in environmental law earned him a spot on New Jersey Monthly Magazine’s list of young Rising Stars® two years in a row, an honor bestowed by the magazine’s Super Lawyers®, the top five percent of attorneys in the state.
Michael’s extensive experience representing governmental entity clients includes redevelopment and personnel matters, governmental contracting, third-party liability claims under the New Jersey Tort Claims Act, regulatory enforcement litigation and administrative law matters. He also regularly handles requests for government records made pursuant to the New Jersey Open Public Records Act (OPRA), works with Chasan Leyner & Lamparello, PC’s government entity clients to ensure compliance with OPRA both procedurally and substantively, and has litigated OPRA matters both in court and before the New Jersey Government Records Council.
Michael dedicates significant time to service to the legal community. Michael was appointed to the New Jersey State Bar Association's Committee on Continuing Legal Education and was elected First Vice-Chair of the State Bar's Local Government Law Section. In addition, Michael currently serves on the District VI Ethics Committee by appointment of the New Jersey Supreme Court. Michael also lectures through the State Bar on topics such as the New Jersey Open Public Records Act, Ethics for Government Attorneys and Labor Law for Government Attorneys.
Michael has significant experience in other areas of civil litigation as well, including appellate practice, complex commercial litigation, and general civil litigation. He also deals with the firm’s intellectual property clients on issues involving trademarks, trade secrets and copyrights.
