Hi, my fiance is in jail on a v.o.p the original charge that put him on probation is 4 th degree theft by unlawful taking.

if the underlying charge is a 4th degree he only can get the max. on the 4th degree, 18 months state prison. But he can do more on the new 3rd...

A PCR is very difficult and involved. The new Gaitan Case also changes the landscape. it will be hard to find an attorney to do this pro bono.

t doesn't matter if the final is issued. The terms of your probation likely include no arrest and /or no convictions. The Final is not a conviction...
