TOP TBI Expert

Stuart Casper is the be all and end all of TBI cases. And he is a lovely human being. HIGHLY RECOMMEND!

Posted by anonymous | May 28, 2018 | Workers Compensation

No emphathy. No listening skills. Emotional Wreck.

I met with him & his associate. He took me to a basement conference room. He was very full of himself. He seemed to believe this was a test of my ability to survive cross-examination. He seemed to side with my employer; he diagnosed me as NOT suffering a concussion (contrary to my doctors) and tri...ed to convince me that I hadn't passed out. He did pry extensively into my personal life (that's it's own reward, isn't it?): 1) who were my doctor's (you don't need a neurologist! Pffft!); 2) did I take a picture of my hip injury; 3) was it a good picture; 4) was the injury visible now; 5) was I married or single; 6) any children; 7) how long had I been in my profession; 8) what kind of work had I done before; 9) did I live alone; 10) when did I graduate high school; 11) when did I graduate college; 12) how long had I lived in town; ... and so on. He made it all about me. He was not too interested in the actual events that transpired or my injuries (except the hip contusion).  No questions about my employer's corporate culture or safety record (or lack thereof). I told him how my employer lied on the report to the state Workmen's Comp (reported a contusion only)... when the emergency room doctor clearly diagnosed and documented: contusions AND a concussion. The impression: he didn't give a damn how I was injured or the circumstances; by a company employee who violated company policy. Didn't care that any laws might have been broken; I showed him the federal statute.  He doesn't listen: got very angry when I kept interjecting his long speeches to tell him details of my story (it's all about him). He couldn't give a rats ass about me and my petty concerns. He glared at me and asked me if this was my usual behavior (or something like that). Impression: she doesn't know her place. "How do you know you passed out?" "Did somebody tell you?" I detailed the circumstances, including how the nurse came in to observe and monitor me in the bathroom (to make sure I didn't pass out again and hurt myself). BTW: you don't have to pass out to have a concussion. So I don't get his point for harping on that. Evidently, also not important: that my blood pressure went up to 200. He sort of shrugged, said something like: "so what?" Wasn't impressed by the federal law that was violated. Visibly angry when I asked if the state police acted improperly (by not issuing a ticket to the company trainer responsible for my fall) and could I sue them: "what for?" He bristled. He eventually launched into this long explanation about how most people who think they passed out after an injury, hadn't really passed out; it's a memory issue; and here is what happens in the brain. He's the lawyer who would be representing me, right? Not the expert testifying at trial? When I interrupted the lesson to say: "or I passed out." He got very upset. He said I was being rude. He pushed back from the table and got up and walked out. It was very shocking to see this lawyer display the side effects of a concussion: I have read that concussion victim can be very emotional and reactionary. As we walked out of his moldy basement, the associate (an attractive blonde who does the actual work on his cases according to an office colleague) whispered: "Good luck with your case."  While he made an impression as a brain expert, not impressed with him as a lawyer.

I am sorry that your experience was so negative. However, your comments suggest that at least part of your unhappiness may have been the bad news I was delivering. First, you appeared at my office without an appointment. Upon learning the nature of your injury, I agreed to meet with you and my associate and I brought you to our basement conference room. Our primary conference room on the first floor was otherwise occupied. Frankly, I have never noticed any mold in the building although it would not be surprising if the basement was slightly musty. Second, early in our conversation I learned two important facts: 1) that you were injured out of state (somewhere out west as I recall); and 2) that your accident was caused by a fellow employee of your Nebraska based employer. At that point I informed you that you would likely require an attorney licensed in Nebraska and that I wanted to obtain sufficient information about your claim so I could assist you in securing a lawyer in Nebraska. For that reason I began to ask you the same questions that I ask every new client about their lives. My questions included your date and place of birth, your education, your employment history, your family and your current living situation, your medical and psychological/psychiatric history, if any, and the course of events from the inception of the event that led to your injuries up to the time of your meeting with us. Part of the interview included your recollection of the events from the time of injury through the establishment of continuous memory for the events surrounding the incident. That inquiry moves from memory to memory because often, emergency department personnel do not take the time to obtain that information. I consider it to be important information in the context of a suspected concussion or loss of consciousness and helps TBI specialists distinguish between a loss of consciousness and "gaps in memory" that form the basis for a diagnosis of amnesia. Your comments on this web site minimized the importance of information that I consider to be important. Unfortunately, my opinion that your case would likely be limited to a workers' compensation claim and that I was trying to do you a favor by obtaining the information that I thought was important in order to make some calls to line you up with a colleague in Nebraska did not register with you. You kept cutting me off to tell me the details of your story that, as I repeatedly explained, had little importance in the context of my trying to help you. I spent considerable time with you and you continued to resist my efforts with comments that revealed that you were not interested in what I had to say. Your comments left on this web site revealed only snippets from my comments but not an understanding that I was trying to help you.

Amazing Results

Attorney Casper is one in a million. As a professional, I have worked with many litigators and none have had the depth of experience, understanding and empathy that he has. I had a very complicated case. Stewart spent the time to thoroughly grasp the devastating effects of what happened to me due t...o medical malpractice. Because of his expertise and commitment, he succeeded in getting ten times the defendant's initial offer -all in a single day. My family will forever be grateful for his accomplishment and caring.

The best attorney and a great man

"Stewart Casper is an incredible attorney. Four and a half years ago I was involved in a slip and fall accident and sustained injuries that resulted in permanent disabilities. We had initially retained a different attorney who had completely mishandled the case and insulted us by questioning our unde...rstanding of the English language. Two weeks before the trial we made the decision to retain Attorney Casper and it was the best decision we could have made. His great knowledge, experience, and attention to detail was evident in how he handled our case. Not only are we extremely happy with the result of our case, but Stewart also treated us with respect and compassion, it didn't matter how heavy our accents were. We would certainly recommend Attorney Casper to anyone, especially to other Russian speaking individuals or anyone else from Eastern Europe." - Natasha

Highly recommend

Three years ago, our daughter was involved in a serious car accident, and experienced a severe subdural hematoma requiring more than a year of intensive supports and rehab. It was a horrendous experience for Reiko and our family. Throughout the experience, Stewart Casper and his team were by our side...s…not just for the legal support, but also for medical and personal supports. Stewart gave us the ability to focus on our daughter’s TBI needs while he handled the complex and necessary legal aspects. As a result, Reiko has made remarkable progress, and Stewart’s efforts have given her the opportunity to continue her recovery and regain important aspects of her life. Reiko is living successfully independently, is loving her new apartment and friends, is moving smoothly through her program to complete her BA, has a "boyfriend," and is having quality sibling time with her brother. She's got a neurologist and other medical supports, and she's finishing up a brief stint with a counselor to "talk through" some questions. All very good. Three years later, we still marvel at Reiko's remarkable recovery from her life altering accident, and will be forever grateful for the assistance we got from our personal and professional supports network. And, Stewart Casper had a prominent and much appreciated place in that support network. We would recommend him highly and without reservation.

  • Legal community recognition Peer endorsements, associations, awards
  • Legal thought leadership Publications, speaking engagements
  • Discipline Disciplinary information may not be comprehensive, or updated. We recommend that you always check a lawyer's disciplinary status with their respective state bar association before hiring them.
