Is smoking banned in your unit? If it isn't you'll have a real problem saying this is a nuisance.

You can walk away... but they will definitely go after you.

I *always* recommend an attorney when fooling around with the title to your property. A basic mistake can end up costing a lot in the long run. ...
I am suing my Landlord in small claims court because my apartment did not have adequate heat and I was forced to move out.

Look to your lease for the answer to that.
Generally, the LL would be responsible for the fence. The yard could go either way.
