OUTCOME: $850,000.00 was awarded to the Estate of William McDermott and $435,000.00 to Madeline McDermott, for a total verdict amount of $1,306,371.65 with costs.
The Connecticut Department of Transportation was removing a sugar maple tree along Main Street in Cromwell, Connecticut. When the trunk of the tree was approximately twenty-five feet high, Mr. William ...McDermott, then 77 years old, walked down the sidewalk and was standing between two DOT workers and talking with them, about 55 feet from the trunk. A 10 foot section of trunk was cut, landing on a 25- inch log on the ground, which flew up and hit Mr. McDermott in the head, knocking him down to the sidewalk, causing severe head injuries which resulted in his death. His estate was a plaintiff for wrongful death against the State of Connecticut, as well as his wife Madeline McDermott for loss of consortium. The Court found the State of Connecticut negligent for allowing Mr. McDermott to be in the work area and awarded damages to his estate and to Mrs. McDermott.
