OUTCOME: Judgment of Possession Affirmed

A mobile home park and a tenant entered into a written lease. The tenant did not make all of the necessary rent payments. The landlord sought to evict the tenant and won a judgment of possession at t ... he trial court. The tenant argued that the eviction did not comply with state statute and the park owner violated the Connecticut Unfair Trade Practices Act. On appeal, attorney Mahon represented the park owner. The Connecticut Appellate Court upheld the trial court decision, agreeing wholeheartedly with the arguments raised by attorney Mahon.

OUTCOME: Trial court decision reversed and case remanded for further proceedings.

The plaintiff mobile home park sought to evict a tenant for non-payment of rent. The trial court said that the tenant could not be evicted because she owned shares in the corporation that was trying t ... o evict her. The case was appealed and attorney Mahon handled the appeal on behalf of the landlord. He argued that, under the relevant landlord-tenant statutes, it was inconsequential that the tenant owned shares in the landlord-company. The Appellate Court agreed with attorney Mahon's argument and reversed the trial court's decision. This was a victory for attorney Mahon and his client.

A mobile home park sought to evict tenants for failure to pay rent. The court entered judgment in favor of the mobile home park. The tenants abandoned their mobile home, so the park asked the court t ... o find that the property was abandoned and order a sale of the home. The town, which had an interest in the abandoned home, argued that the abandonment sale should not go forward because the town had allegedly made certain disclosures in an unrelated foreclosure action involving the same parties. The trial court ordered the abandonment and a sale was held. After the property was sold, the park asked the court to discharge any liens and to collect its costs. The town objected on the basis that the park had waived its right to collect its statutory costs. The town appealed the trial court's decision. On appeal, attorney Mahon represented the mobile home park and drafted a legal brief to the Appellate Court. In that brief, he argued that the abandonment sale was appropriate and the park had not waived its right to seek abandonment costs based on the supposed admissions it made in the foreclosure case. The Court's decision was a victory for attorney Mahon and his client.

An association of residents at a mobile home park alleged that the park owner failed to properly maintain the park. They brought an action seeking a declaratory judgment and damages for unfair trade a ... ctivities. The trial court ruled in favor of the mobile home park. The association appealed. The Appellate Court upheld the judgment. The case was appealed to the Supreme Court. It upheld the judgment in part and remanded the case back to the trial court level to resolve the unfair trade practices allegation. The association ultimately withdrew the action against the Park. Attorney Mahon was retained by the Park and assisted it in all facets of the appellate experience, including briefing the matter before both the Appellate Court and the Supreme Court. He also argued the case before the Appellate Court.

A mobile home park owner sought to evict a tenant due to lease violations. The tenant alleged that the eviction was retaliatory in nature. The trial court ruled in favor of the mobile home park. The ... tenant appealed. Attorney Mahon assisted the Park in handling the appeal and helped draft the brief to the Supreme Court.

OUTCOME: Judgment in favor of the plaintiff upheld by the Connecticut Appellate Court

The case involved a real estate broker who was unfairly denied a commission by his client. The broker sued to recover the commission from the client and the trial court ruled in his favor. The client ... appealed the trial court’s decision and argued that no commission was due. The broker’s trial attorneys then enlisted my help draft the brief to the Appellate Court. The Appellate Court ultimately ruled in favor of the broker and determined that the trial court had correctly decided the case. The losing party later tried to appeal the case to the Connecticut Supreme Court, but I helped draft a brief arguing that the Court should not get involved, the Court denied the request to appeal.

I represented a man who was injured after a deck collapsed. He sustained serious injuries to his ankle and back. We sued the owners of the deck. There was a factual dispute as to whether or not the ... homeowners were aware that the deck was defective and might collapse. The case was litigated and depositions and written discovery occurred.
