OUTCOME: We won.

Betty Ives bequeathed her farm to the Cheshire Land Trust (CLT) and the seven greenhouses on the farm to Timothy Casey. When that happened, Casey leased the rest of the property from CLT. Unfortunatel ... y, Casey couldn’t pay rent and CLT had to evict him. In court, Casey argued that the land trust hadn’t given proper notice to evict him and, anyway, he had an implied easement to come onto the property to use his greenhouses. The court disagreed, finding that CLT had given proper notice and that the greenhouses were not fixtures but rather removable personal property.
