While dismissing the charges in the companion case entirely, the state filed a substitute information in this case dropping the misdemeanor charges and only charging the defendant with the infraction of operating a motor vehicle without minimum insurance. My client plead guilty to the motor vehicle infraction and paid a $90 fine.

My client was charged with felony risk of injury to a minor and misdemeanor assault in the third degree for allegedly causing a bruise on a child's bottom. After months of unsuccessful defense efforts ... to convince the prosecution that there was no credible evidence against my client, the matter was set for a bench trial. Shortly before the trial was to begin, the prosecutor offered a nolle prosequi because she finally realized she had insufficient evidence for trial.
