If he was deported, you will need to file a immediate relative petition. Please note, if deported, he will need a waiver to return to the USA.

If the Judge grants you voluntary departure, then yes.

Yes, your employer would be able to still apply for the H-1 in April, but the time is now to start working on getting all the documents for that...

More information is needed. For example, if you are married to a US citizen you may have an option.
