OUTCOME: Not guilty.

DS was arrested for various offenses in the City of Attleboro. The police alleged that while he was being taken into the booking area, DS committed an assault and battery on a police officer and he wa ... s then charged with assault and battery on a police officer. Attorney Caramanica promptly obtained the video of the incident, and learned other videos were not preserved. After a 2-day jury trial, DS was found not guilty. Video presentation and still photos presented to the jury by Attorney Caramanica were a key factor in the outcome of the case.

OUTCOME: Not guilty, CWOF.

MG was charged with 1 count of improper storage of a firearm and 3 counts of unlawful possession of a firearm and large capacity firearm/ammunition. The firearms were found when the police entered the ... home during a domestic incident. One firearm was observed in plain view and unsecured, resulting in the improper storage charge. The large capacity firearm charges resulted from the police making an warrantless search of a safe where the large capacity firearm and ammunition were stored. Attorney Caramanica filed a motion to suppress the evidence. After a hearing, the court allowed the motion to suppress the firearms and ammunition found in the safe, but not the shot gun found in plain view. The 3 counts resulting from the warrantless search of the safe were dismissed. The improper storage charge resulted in a continuance without a finding for 1 year, eventually to be dismissed.

The defendant was a front seat passenger in an car occupied by 2 males. The driver pulled into a gas station/convenience store, went in and made purchase, and returned to the car. The rear set male p ... assenger then left the car and went into the store - allegedly committing a robbery. The car had left before the 3rd male went inside. Minutes later, the car was stopped with all 3 present inside. A search of the car found no evidence relating to the robbery. Defendant was charged with robbery and conspiracy to commit robbery. A motion to dismiss was filed, challenging whether there was probable cause to charge the defendant, because at best the evidence showed she was merely present.

Cross examination of police and forensic experts demonstrated that there was no forensic evidence linking the defendant to the alleged crimes.
