Cannot file an H1 extension if you are no longer in H1 status. Once the 140 is approved, you should be able to request a 3 year H1.

Hi there- you didnt get the I-94 because you did not prove that you had legal status on Oct 1st. You will need to go outside, get the H1 stamped...
