This has been a problem, especially when the rest of the family is immigrating. We have done student visas in these situations, or H1 visa.

Hi there- you should talk to an attorney in private to discuss. It will depend on whether both those marriages were true marriages or not.

Yes, you can file directly. I do recommend hiring an attorney or going back to the agency. Getting visas approved for au pairs in not that easy.

Yes, the consular office does have the right to ask why you will be visiting the US and whether you intend to stay.
