Talk to the DSO -- OPTs are for 12 months or the STEMS opt. If you got the 12 month OPT previously, you should still qualify for the STEMS...

Yes you can get H1 directly. If you dont have OPT, CAP GAP rules do not apply to you. You will need to maintain legal status till the H1 start date.
