During trial, the CW introduced the 911 call from the alleged victim stating that her boyfriend, who she identified as my client, was hi...tting and beating her. A police officer testified that, upon his arrival, he came into contact with the alleged victim and she had a fat lip, several bumps on her head, and it appeared as if she had been crying. Through cross-examination of the police officer and the alleged victim's mother, Attorney Riccio was able to establish a number of inconsistencies between their testimony and the 911 call, resulting in the jury returning a verdict of Not Guilty.

The breath test was excluded from evidence prior to trial after Attorney Riccio successfully argued the Commonwealth failed to establish that the breath test machine was properly certified at the time the Defendant's breath test was administered. At the close of trial, where the evidence was the Defendant had a strong odor of alcohol coming from her person, did not pass all of the field sobriety tests, and had bloodshot eyes and slurred speech, a jury returned a verdict of Not Guilty.
