TM, a 14-year-old high school student, was arrested for bringing a switch blade to school. The police were called to the school after a teacher noticed the knife in TM's pocket. As is typical in Juveni ... le Court, the prosecutor agreed to give TM a "chance" to have the case dismissed so long as TM stays in school and does not get rearrested.

OUTCOME: Not Guilty

Mr D drove too fast, 50 mph in a 35 mph zone. He was pulled over by a local police officer. The officer noticed standard signs of alcohol impairment - slurred speech, red/bloodshot eyes, strong odor of ... alcohol. Mr D was asked to exit the car; when he did so he was "extremely unsteady" on his feet. According to the officer, Mr D failed all the field sobriety tests. Additionally, Mr B admitted several times that he "shouldn't have been driving" and that he "knew better." However, Mr D took the breath test and blew .07%. Rather tan take our chances with a tough judge, Mr D elected to have a jury trial. The jury found Mr D "Not Guilty."

OUTCOME: Pretrial Probation - case to be dismissed if client stays out of trouble for one year

Boston police responded to a 911 call for reported "Domestic Violence in Progress." They arrived at the house of Mr B's fiancé and were given entry to the home by the fiancé's roommate. The roommate ca ... lled the police initially. Inside the home they noticed that several household items had been turned over and/or broken. Mr B and his fiancé denied that any physical altercation took place. However, the police charged Mr B with Malicious Destruction of Property. The prosecutor in this case felt very strongly that Mr B's fiancé was in an "abusive relationship." This, of course, was not true. Eventually, the prosecutor offered to dismiss the case if Mr B does not get in trouble for one year.

The criminal record of Ms. M, a young lawyer, was sealed today. Earlier this year Ms. M faced a charge of Assault and Battery. The case grew out of a disagreement between Ms. M and her husband. It was ... a case that probably should not have been brought in the first place and it was promptly dismissed. Today, a different judge agreed that event though her record shows a "dismissal" the presence of an entry on her criminal record creates bias and prejudice and could negatively impact Ms. M's ability to obtain and maintain employment. As it stands now, Ms. M's record states - "this person has no adult record."

OUTCOME: Motion to Suppress Allowed -- Case Dismissed

Ms C and her daughter had a big fight at home. Ms C left the house and her daughter called the police; she told the police that her mom had hit her and was now driving drunk. The daughter provided the ... make and model of Ms C's car along with the license plate. Ms C's car was stopped in the neighboring town. Ms C was stopped only based on the call, not for any other reason. The officer who made the stop testified that he only knew of the car based on what the dispatch said. He did not know the name or identity of the initial caller. At the Motion Hearing we successfully argued that the officer did not have Reasonable Suspicion to stop the motor vehicle.

A sobriety checkpoint caught my client in its indiscriminating net. Unfortunately for Mr. F he had been previously convicted of OUI once before. After more than a year of evidentiary requests and motio ... n hearings the prosecutor agreed to reduced the case to a 1st offense, even though Mr. F's prior was less than 10 years old. It was a bitter pill for Mr. F to swallow, but the offer was too generous to pass up.

Just before 2am, at a neighborhood bar, Mr. T, a young professional, became involved in an altercation with two other patrons. They accused him of stealing their belongings; specifically, a purse and a ... coat. The police responded and Mr. T was found to possess the other people's items. The alleged victims told police that Mr. T assaulted them. A negotiation with the prosecutor led to a reduction in charges, from felonies to misdemeanors.

Mr. Q, a commercial truck driver, slept in his truck one night in an effort to get away from his wife. The wife asked the Chelsea police to check on Mr. Q. The police roused him from his slumber. Mr. Q ... did not take kindly to being woken up in such a manner. He did not immediately submit to arrest, so the police struck him on his shins with their clubs. On the day of trial the prosecutor agreed to reduce the charge to Disorderly Conduct.
