also known as Dave Travers
My practice has developed around significant adversarial proceedings, while focusing on client-counseling and alternative dispute resolution processes to manage and efficiently address clients' claims. I have been responsible for state and federal litigation proceedings, as well as arbitrations, mediations, conciliations and direct claim negotiations for owners, general contractors, design-builders and subcontractors on both public and private construction projects.
My practice also includes drafting construction contracts including, design contracts, design-build contracts, construction manager contracts and many other types of project documents. In drafting these documents, the focus is always on the minimization or control of risk factors to protect project cash flow and profit margins from unexpected circumstances and claims.
In addition to working with members of the construction industry, I am regularly involved in varied litigation matters for both business and personal clients, including claims for non-payment and/or breach of contract, zoning disputes, enforcement of real estate agreements, insurance claims on behalf of policy holders, dram shop claims, commercial evictions, uniform commercial code disputes, non-competition claims and other restrictive covenant employment claims, and probate disputes.
Specialties: Complex commercial litigation in addition to construction industry experience with wastewater collection and treatment facilities, highway and tunnel construction, and vertical construction work.

As an architect and principal of a firm I appreciate working with David. His experience as a litigator is what distinguishes him. Our work together over the last five years has been around front end alignment; selecting appropriate design contracts, letter agreements vs AIA docs, negotiating NDAs and...
