It's pothole season again!!! There is nothing quite so frustrating as hitting an oversized pothole and sustaining tire, rim, and structural damage. Many people do not realize that pothole damage to t ... heir automobile is not necessarily their burden alone. Cities and municipalities have an obligation to maintain their roads in a drivable condition pro actively, and a failure to do so reasonably is actionable. In other words, if your car is damaged in a pothole, you can bring a claim against the city or town. They will probably try to deny the claim, but the reality is they are liable for their negligence, and if you press the claim, you may recover against them. Massachusetts had a very wet, warm spring thaw this year and as a result, road conditions and pothole damage are much worse than usual. Some major roads and highways, including route 93, the main highway to Boston, are in horribly bad states, and a lot of people are suffering damage as a result.
