After reviewing the details of the 4th amendment waiver client had previously signed, it appeared the officers exceeded the scope of their authority. After a pretrial conference with the District Attorney, all warrants were dismissed and no charges were filed.

Client was an attendant at a high school graduation party. He was arrested along with all of the attendants at the party for possession of alcohol by a minor. Client told the officers that he had not ... consumed any alcohol and demanded he be given a breathalizer. The police officers refused to give client a breathalizer and he was arrested. In this case we argued that the officers had failed to preserve the necessary chemical evidence for client's defense, and the state should be punished for spoliation of evidence pursuant to the Supreme Court's holding in Youngblood v. Arizona. Ultimately the State agreed to dismiss all charges against this client and his record was cleared.
