Short answer is no, it is not a nonpossessory, nonpurchaser money security interest. The bank probably has a security interest in your home. Home equity is what used to be called 2nd mortgages. It is subordinate to the first mortgage, however, it is a secured loan, with the security being your home. It would be wise to consult with a bankruptcy attorney.

Generally, if you were a "permissable driver", which I assume you were, then girlfriend's insurance policy covers. If not a permissable driver, then depending upon the type of coverages you have in your policy, your policy will cover.
No. ALthough it doesn't mean they won't. Perhaps you can pay them a substantially smaller amount. Consider sending them $10 - $20 bucks a month, attn the name of the threatening party. Even a trickle of money to the NY company is better than nothing. Especially during these economically tough times. Usually this will keep them off your back.
You need a lawyer. The insurance company will do things in their interests only. They will not consider your interests. Only a good lawyer in the area of personal injury and wrongful death cases will get you the money you are entitled to.
