    Disagree with Pamela here. If you only sued them for property damage, then you can still sue for bodily injury. They are different fundamental rights. But you must prove that your first lawsuit was only for property damage.

    Yes, you will be eligible. You are eligible to attend traffic school only once every eighteen months if you do not have a commercial driver’s license.     Unfortunately for all of us, insurance companies only care about one thing: their bottom line. Assuming there is not police report with attributes fault to the other driver, you will have to call the other insurance company and explain to them why it was their insured's fault. DO NOT GIVE THEM A RECORDED STATEMENT. Just explain where the accident happened, and what your damages are. Better yet, send them a letter.     You need more facts. It depends on who has right of way. In this example, the car driving down the street probably has right of way. However, if that car is speeding, if may be at fault for the accident.

    To give you the right answer, I would need a little bit more information. Generally speaking, there a statutory obligation to pay the hospital, or government agency that paid your grandson's medical bills. However, if your grandson received the maximum policy limit on the from the insurance company, sometimes one can argue that the medical bills should be waived.     Get a traffic attorney. If you have a winning defense, you can win at trial and not get the ticket on your record.
