  • Under new Ohio SB337, you can get 2 misdemeanors or One Felony and One misdemeanor sealed. Will a DUI conviction prevent this?

    A domestic violence charge, reduced to assault is the charge to be sealed, from 3 yrs ago. The OVI is on the record, and found guilty.

    I am sorry to report that you can only have one conviction expunged and the DUI will never be expungeable under Ohio law. A DUI is a criminal offense and my opinion you can't get anything expunged under the scenario you have prevented. Wish I had better news and wish you had better conduct the DUI sticks.

    I agree with my learned counsel who have previously answered. No knock warrants are generally unheard of. If the police are going to arrest you they will generally knock and anounce. If they are going to conduct a search warrant and you are an arch criminal they will conduct a raid, but will first knock and yell "Police Search Warrant" and then they can use a battering ram to enter.

    Get an attorney ASAP and turn yourself in, because they will be back. It is far better to turn yourself in then being given a set of "siliver braclets" and a "limo" ride in a police interceptor to the "graybar motel".

    Turn yourself in, you may get released on your own recognizance or ROR, but based on the fact you have a warrant don't count on it.

    Call your divorce attorney and he will advise you as to the appropriate motion to file.

    I might also file a police report for theft. See if they are incorporated in Ohio and if they are send a letter to their statutory agent regarding the matter and call the BBB.

    You should absolutely and unequivocally say nothing about any employee terminated or not, and if you do you may be liable for slander depending on any comments. Say nothing.

  • Can they drug test for k2 using an urinalisis test? I on probation and have to drop once every two weeks .

    I don't think many people know what actually is in K-2. If it shows up in a urinalysis you may be violated. if they are using a 5 panel test it might not show. Probation is a privilege, do yourself a favor and stay clean a VOP could land you in jail depending whether your PO is a hard ass. The drugs generally tested for in a five panel are: marijuana, benzodiazepams, cocaine, opiates and methamphetamine.

    Try to do so without the involvement of the authorities and encourage your daughter to seek drug treatment, if she refuses you can involve child service authorities, but there will be ramifications. Best to handle this through motherly love and concern. I would suggest you avoid state involvement.

  • I was sold a 2006 Altima, but found out it was a 2004 model when filing a comp claim in 2012. Is legal action possible?

    The body shop that was ordering after market parts informed me that Nissan confirmed that the needed parts didn't match the 2006 model. My sales contract and registered VIN state that the vehicle is a 2006 and that's what my financing was based on.

    It sounds like you may have a fraud claim against the seller of the vehicle if there was a material misrepresentation about the year the vehicle was manufactured. Check the title and run the VIN number through CARFAX. There may be more than one vin number on the vehicle. Talk to a mechanic and ask him to see if all the VIN numbers match and research the history of the vehicle.

    Yes you could be liable for the damage to her car and without insurance the repairs may be your financial responsibility, there is a strong possibility that an insurance claim will be filed and when it is found out that you don't have insurance your license will likely be suspended. A driver's license is a privileged and can be suspended if you drive without insurance. A driver's license does not mean you can drive a an uninsured vehicle. Who do you think should bear your responsibility for insuring the public against your irresponsibility.

    Sorry, no sympathy here. Get insurance and be a responsible driver. I would bet 10 to 1 that you continue to drive without insurance.
