Can I go to court to fight a judge's decision for me to pay $25,000 in back child support?

Asked by a user in Long Beach, CA - about 3 years ago.

Hello and thank you for your question. I would suggest that you file a motion to determine child support arrearages, and to have the court order a reasonable repayment of the arrearages, if they are owed. You would be able to get credit for the time that your child lived with you, but you need to see where this $25,000.00 figure comes from. I would highly suggest that it would be in your best interests to have an attorney review this matter for you. Best wishes, Attorney Karen Miller

Asked by a user in Torrance, CA - about 3 years ago.

Hello and thank you for your question. My suggestion is that you download a demo, fully functioning version, of xspouse.com, and figure based on the current situation: 50/50 custody, and your and her gross monthly incomes, whether you would have to pay child support, and if you did, are you paying the correct amount. I am the non-costidial parent, How can I have the child support case transfered to another court? A court order has been done

Asked by a user in Torrance, CA - over 3 years ago.

Hello and thank you for your question. I would suggest that since neither party resides in San Bernardino, that you file for a motion to change venue. If you do not believe that the amount they are charging you is correct, you can run the figures via a free software at xspouse.com where you can download a fully functioning version that is comparable to the dissomaster software used at the courts. If the wrong information was used to calculate child support, I would suggest that you schedule a...

If I ask for and get (he'll probably sign) full legal custody, am I still entitled to child support in the state of TX?

Asked by a user in Austin, TX - almost 3 years ago.

Thank you for your question. You are entitled to child support regardless if the other parent visits with your child. I would suggest that you immediately assign your case to the TX Child support division--their 24-hour hotline is 800) 252-8014and the link to their website is http://www.oag.state.tx.us/cs/parents/faq.shtml Best wishes here, Attorney Karen Miller
