Outcome: Judgment in Favor of Plaintiffs
Description: Plaintiffs asserted claims against Windermere and its agent for breaches of fiduciary duties and failure to disclose conflicts of interest. After a trial before a 12 person jury, the jury found that the agent had breached his fiduciary duties to plaintiffs when he failed to disclose his financial interests with a home remodel contractor that he recommended to plainitffs in order to pursuade them to purchase a home. The contractor was unlicensed at the time, and caused over $500,000 of damage as a result of poor workmanship, among other things. The jury awarded plaintiffs $522,000 in damages, and the Court awarded an additional $500,000 in attorneys fees to plaintiffs.
