L&I is a resource in these situations, but it isn't the only one. A major drawback of using L&I to resolve wage claims is that they will not go after statutory penalties against the employer. You should know that RCW 49.52.070 allows an underpaid worker to collect DOUBLE the amount owed, plus attorney's fees, if a court finds the employer willfully withheld the wages. If you are a part of a union, consult with your union rep and look at your contract. Your contract should cover basis and correct process for termination. I'm not clear on whether you're asking about unemployment insurance. You ought to apply for that if you haven't already. The Unemployment Law Project has great info on the subject. You should definately request a discretionary waiver of the overpayment. You also may ask L&I to reconsider the overpayment because it was due to adjudicator error. See RCW 51.32.240. Either way, you have a short time in which you must act to preserve your rights. You may know the system well enough to handle this yourself, but if not, it would be a good time to consider hiring an attorney.
