    In general larceny cases by civilians or dependents on a military installation will be prosecuted by a JAG SAUSA (special United States Attorney) in US District Court. However in your district I would assume they have pre-trial diversion. Most federal districts divert these small first time shoplifting cases.     TDS has a form that gives you a summary of all the Benny's you keep. If you have 17 years in you probably have a number of good enlistments already behind you so you should retain what you earned from them like gi bill. When you out process you will receive a briefing on this subject. You can also talk with any of the NCOs at JBLM TDS, they know this stuff

  3. I was read a Company Grade article 15. Now they want to make it Field Grade. Is that right?

    If it was only the first reading, the answer is yes. The command can change it to make it a field grade. If you have already been there, you would need to go BACK to TDS (Trial Defense Services), because the possible punishment at field grade is more severe and you need to know this as well. You may well decide that you now do not want the matter to proceed by Article 15 and that you want a court martial. This is a matter that you really need to talk to a TDS attorney about.     If you are a retiree and live near an active duty installation you should check to see when the post Legal Assistance office sees retirees. They should eaily be able to answer question and let you know if you need to hire private counsel as they can only advise not represent. This is a bread and butter question for JAG legal assistance attorneys. Good Luck

    I concurr with the answers you have received. If you receive a GOMAR you need to consult with military defense counsel or experienced civilian counsel to assist you in drafting your rebuttal. Further adminstrative action on the part of the command may depend on the characterization of the GOMAR. You should not hesitate to ask for additional time to draft your response. Military Counsel can do that for you.
